These Terms of Use govern your use of thenoveltalk.com (the “Site”) and our waitlist, operated by NovelTalk (“NovelTalk,” “we,” “us”). By using the Site you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. What the Site is

The Site describes NovelTalk, a platform we are building to connect independent authors with readers. The platform is not yet available. The Site and waitlist are provided for information and to register interest.

2. Waitlist

• Joining the waitlist is free and does not create an account or guarantee access, a launch date, or any particular feature.

• Founding Member perks, passes, badges, and plans mentioned on the Site are promotional. We may change their details, terms, or availability before launch, and they have no cash value and cannot be transferred.

• You must be at least 16 and provide a valid email address that belongs to you.

• You can unsubscribe at any time using the link in our emails.

3. Acceptable use

Do not: use the Site unlawfully; interfere with or disrupt it or its security; scrape or copy it by automated means without permission; submit false, harmful, or someone else’s information; or attempt to access non-public areas.

4. Intellectual property

The Site, including its text, design, graphics, and the NovelTalk name and logo, belongs to NovelTalk or its licensors and is protected by law. You may view and share links to the Site for personal, non-commercial purposes. You may not copy, modify, or reuse our content or branding without written permission.

5. Your communications

If you send us feedback, ideas, or suggestions, we may use them without obligation or compensation to you.

6. Third-party links

The Site may link to third-party sites and social platforms. We do not control them and are not responsible for their content or practices.

7. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DESCRIBED FEATURES WILL BE LAUNCHED AS DESCRIBED. Statements about the future platform are plans, not promises.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVELTALK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED US $100. Nothing in these Terms limits liability that cannot be limited by law, including mandatory consumer rights in the EU/UK.

9. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Salt Lake County, Utah. If you are a consumer in the EU/UK, you also keep the protection of mandatory consumer laws in your country of residence.

10. Changes

We may update the Site or these Terms. We will change the date above, and your continued use means you accept the updated Terms. When the platform launches, separate terms will apply to accounts.
